1. Acceptance of Terms

By accessing or using the eKasi Digital Mall website, WhatsApp channel or marketplace ("eKasi"), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use eKasi.

2. What eKasi Is

eKasi is a consumer and merchant-facing digital marketplace where vouchers ("EDM vouchers") are discovered, purchased, issued and redeemed for everyday products and services. eKasi is not a bank, wallet, payment service provider (PSP), automated clearing house (ACH) or settlement/clearing entity. Wallet and payment rail functions are provided by our group infrastructure partners and are governed by their own terms.

3. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to purchase or redeem EDM vouchers. By using eKasi you confirm that the information you provide is accurate and that you have the legal capacity to enter into these terms.

4. Vouchers

EDM vouchers are prepaid instruments issued for use with participating merchants and services. Vouchers have no cash refund value except where required by law, may carry an expiry date disclosed at issuance, and are non-transferable except through eKasi's built-in gifting feature. eKasi is not responsible for vouchers lost due to user error, such as sharing voucher codes with third parties.

5. Merchant Participation

Merchants who accept EDM vouchers do so under a separate merchant agreement with eKasi and/or its infrastructure partners. eKasi facilitates discovery and redemption but is not a party to the underlying sale of goods or services between a consumer and a merchant, and does not guarantee the quality of any merchant's goods or services.

6. Prohibited Use

You may not use eKasi to: engage in fraudulent, unlawful or deceptive activity; attempt to circumvent voucher validation or redemption controls; resell vouchers for cash outside of permitted gifting features; or infringe the rights of eKasi, merchants or other users.

7. Intellectual Property

The eKasi name, logo, "eKasi Digital Mall" branding and website content are the property of eKasi and its licensors and may not be copied, reproduced or used without prior written permission.

8. Limitation of Liability

To the maximum extent permitted by South African law, eKasi shall not be liable for any indirect, incidental or consequential loss arising from your use of eKasi, including loss arising from merchant conduct, network or platform outages, or unauthorised use of your voucher due to your own negligence.

9. Consumer Protection

Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008 or any other applicable South African consumer legislation.

10. Changes to These Terms

We may update these Terms & Conditions from time to time. Continued use of eKasi after changes are posted constitutes acceptance of the revised terms.

11. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa, and any disputes shall be subject to the jurisdiction of the South African courts.
